What Workers’ Compensation Benefits Can I Expect?

After a workplace injury, you are eligible to claim various types of benefits, including: Benefit checks paid every two weeks, at approximately 64% to two-thirds of the amount you were earning from your regular paycheck, with a cap for higher wage earners. The calculation of your earnings will be based on the 91-day period before you suffered your injury.

  • Temporary Partial Disability: If you can return to work after your injury in a limited capacity, such as working at a desk rather than lifting, kneeling, or other physical actions that could slow your recovery or worsen your physical condition, you may be eligible to pursue temporary partial disability benefits. If your employer is unable to accommodate you and provide you with this type of work (which is common in many industries), your employer’s workers’ compensation insurance must pay you 64 percent of your average weekly wage during your recovery.
